On behalf of a class of approximately 4,000 medically fragile children in California, Ellis George LLP partner Richard Schwartz and co-counsel at Disability Rights California, the National Health Law Program, and the Western Center on Law & Poverty, obtained final approval for settlement of a class action lawsuit that will enable children and youth with complex medical needs to get the in-home nursing they need to remain healthy and safe. The case was filed on May 24, 2018 by two children, I.N. and J.B., against the California Department of Health Care Services (DHCS), claiming that the state failed to fulfill its commitment to provide them and thousands of other Medi-Cal beneficiaries like them with sufficient Medi-Cal in-home nursing services to keep them safely at home. Judge William Alsup gave final approval to the settlement after the parties reached a stipulation clarifying that class members would not be prevented from raising other claims for money damages arising out of the same failure by DHCS to adequately arrange for nursing care for the class of affected children.
