Ellis George LLP obtained a $60 million verdict in a trademark infringement action in the United States District Court for the Central District of California. That verdict was the second largest intellectual property verdict in California in 2010. Ellis George LLP represented Neurovision Medical Products Inc., which provides medical devices for nerve location and monitoring. The defendant was NuVasive, Inc. which used the name NeuroVision for its nerve avoidance monitoring system. The jury found that Neurovision had established trademark rights through prior use, that NuVasive had willfully infringed Neurovision’s trademark, and that NuVasive had fraudulently concealed its knowledge of Neruvision’s prior use when it applied to registered NeuroVision.
