Following a four-day trial, a federal court jury in Los Angeles found in favor of Ellis George client Brighton Collectibles on its claim that defendant Believe Productions infringed upon its copyright in a popular Brighton jewelry design. The jury found additionally that Believe had engaged in unfair competition with malice, fraud, or reckless disregard for Brighton’s rights. The jury awarded the entirety of Believe’s revenue from its sales of infringing products. The verdict is the latest in a series of trial victories by Ellis George partners Pete Ross and Keith Wesley in their continuing efforts to protect Brighton against knockoffs. Prior wins include a $10.8 million verdict against Marc Chantal, an $8 million verdict against Coldwater Creek, and a $1 million verdict against AIF Corporation.
