In 1975, two little-known but up-and-coming game developers – Steve Jobs and Steve Wozniak – created the video game Breakout for Atari. The new simple, addictive game became a hit, and helped propel Atari to a spot on top of the video game industry. Over 40 years later, Breakout remains beloved by gamers and a valuable piece of intellectual property owned by Atari. Ellis George today filed suit on behalf of Atari claiming infringement of the Breakout intellectual property by the international food company, Nestle. In the suit filed in the U.S. District Court for the Northern District of California, Atari claims that Nestle used Breakout, without Atari’s authorization, in an ad campaign for Nestle’s well-known Kit Kat candy brand.
